Organiser Terms And Conditions *

The Platform bhogya.online is a brand of Optima e-Solutions GmbH. The following terms and conditions guide Event Organisers about the usage of bhogya.online The Event and Tickets Please provide accurate information about the events and the tickets. It is your responsibility to ensure that you list only valid tickets on bhogya.online. If there are any additional services that you provide along with the event tickets, please mention these very clearly. You warrant that your descriptions of the tickets accurately detail and describe the tickets offered for sale. You also warrant that you own the tickets and are authorised to transfer or resell the tickets. In the event you are reselling tickets for commercial reasons, you warrant that you have the right to do so. It is your responsibility to ensure compliance with the applicable laws, statutes and regulations. Tax on Tickets You are responsible for determining whether you/your firm is required to account for VAT, GST, sales tax or other similar fees (collectively, “Tax”) on the sale of the ticket. We take no responsibility for such issues. If you are required to account for Tax on the sale of the ticket, you should include the Tax (i.e., total) when setting ticket prices on the website. Note that this is separate from any Tax Optima e-Solutions GmbH/bhogya.online is required to charge on its fees. Payment for your ticket sale bhogya.online will process the payments from the ticket buyers on behalf of the Event Organisers. The payment will be made to the Organisers once a week on Wednesdays for the amount of tickets sold minus the service charges as per the agreement. As a seller of the event tickets, you are responsible for collecting and remitting the appropriate taxes in <a href="https://bhogya.online/beyond-the-curtain-into-regular-lives-2/" target="_blank" rel="noopener">connection</a> with the event ticket sales. In the case of a cancelled event, no payment will be made to the Organiser. In addition, the Event Registration Fees will not be paid to the Organiser until the event is successfully completed. If you have already been paid for the cancelled event, we will recover the payment by charging via the Payment Method on file with us. You have to remit the funds due to bhogya.online / Optima e-Solutions GmbH, and these have to be sufficient to cover the refunds due to the ticket buyers, in case of an event cancellation or non-performance. Bhogya.online Fees We charge a service fee for the tickets sold via bhogya.online and this includes the payment processing fees. We prefer that this service fee is included in the final ticket sale price. This fee can be displayed in the check-out process and covers the cost of maintaining the platform, guaranteeing tickets and providing customer service. Please note that service fee amounts may vary by event and are subject to VAT. Paying taxes Optima e-Solutions GmbH / bhogya.online is not responsible in any way for the accuracy or suitability of any payment of any applicable taxes on your behalf. We do not collect taxes on any sales. As a seller, you are responsible for collecting and remitting any and all applicable international, federal, state, or municipal taxes in connection with ticket sales (including, but not limited to VAT). Laws and Regulations You warrant that you will comply with all applicable local, regional, country and international laws, statutes and regulations regarding use of bhogya.online and selling value of the tickets. You warrant that you are over 18 years old and have the legal capacity to make the transaction. You represent and warrant that any information you provide to us, to other members, or to visitors of the Site (a) is not false, inaccurate, misleading, obscene or defamatory; (b) is not fraudulent; (c) does not involve the sale of counterfeit or stolen items; (d) does not infringe any third party's copyright, patent, trademark, trade secret, rights of publicity or privacy, or other right; (e) does not violate any law, statute, ordinance or regulation, including without limitation those governing consumer protection, unfair competition, anti-discrimination or false advertising; and, (f) does not contain any viruses or any programming that is intended to damage, interfere with, intercept or expropriate any system, data or personal information. You agree to indemnify and hold Optima e-Solutions GmbH and (if applicable) any affiliates, officers, directors, lawyers, agents and employees, harmless against all liabilities, costs and expenses (including reasonable lawyers’ fees) incurred by Optima e-Solutions GmbH and (if applicable) any affiliates, officers, directors, agents, lawyers and employees that arise out of any claim asserted by a third party that involves, relates to or concerns any of your actions or omissions on bhogya.online. Additional Policies and Terms and Conditions This Agreement incorporates by reference the Privacy Policy and the Terms of Use of bhogya.online.

TERMS AND CONDITIONS FOR BHOGYA.ONLINE Introduction These Website Standard Terms and Conditions written on this webpage shall manage and govern your use of our website, Bhogya.Online and our parent website, optima-e-solutions.com and other content and services linked to this agreement. These Terms will be applied fully and affect to your use of this Website. By using this Website, you agreed to accept all terms and conditions written here. To create an account and interact with participating Services click on the Sign In link on the Home page or other pages and create a profile. The information you submit directly to us or through a Third-Party Service (defined below) to create an account must be accurate and must be kept updated by you by visiting My Account Page. Your failure to do so will constitute a breach of the Agreement, which may result in immediate termination of your account. Please consider it your responsibility to notify us of any changes to account information, including, but not limited to your contact information. You are responsible for maintaining the confidentiality of all your passwords and are responsible for all use of your account. It is therefore critical that you do not share your account information with anyone. In the event someone else uses your account as a result of your failure to keep your account information secure and confidential, you may be held liable for losses incurred by Bhogya.Online and Optima e-Solutions GmbH and you agree to indemnify Optima e-Solutions GmbH from any third-party claims arising from such actions. Also, you agree not to use the account, username, email address or password of another member or subscriber at any time and not to allow any other person to use your account. You agree to notify Optima e-Solutions GmbH immediately if you suspect any unauthorised use of, or access to, your account or password. Bhogya.Online and Optima e-Solutions GmbH shall retain the right to change your username, but no obligation, for any reason, including, without limitation, if the username you have selected violates this Agreement. If you have uploaded a picture to your profile, Optima e-Solutions GmbH shall also retain the right, but no obligation, to review any profile pictures provided by you. Access and Use of Bhogya.online The Services are intended solely for your personal and non-commercial use. Bhogya.Online and Optima e-Solutions GmbH may change, suspend or discontinue a part or all of the Services (or any feature thereof) at any time. Certain limits maybe imposed on certain features and services offered on the Services or access to parts or all of the Services maybe restricted without notice or liability. You acknowledge that from time to time part or all of the Services may be inaccessible or inoperable for any reason, including, without limitation: (i) equipment malfunctions; (ii) periodic maintenance procedures or repairs which we may undertake from time to time; or (iii) causes beyond our control or which are not reasonably foreseeable by us. You acknowledge and agree that Bhogya.Online reserves the right to charge a fee for any of the services provided. We will provide you sufficient notice about any change in the fees and also inform you about the way to cancel you subscription, if you donot agree to the changed fees. Your continued use of our Services, after the change to the applicable fees, would amount to you agreeing to the subscription fee or increase thereto and you will be responsible for paying such fee for the balance of your subscription service. Any unused portion of the fees resulting due to a termination of any Service or cancellation of the Subscription by you or by us will not be eligible to a refund. Governing Law & Jurisdiction These Terms will be governed by and interpreted in accordance with the laws of the State of Hessen, Germany and you submit to the non-exclusive jurisdiction of the state and federal courts located in Germany for the resolution of any disputes.
